During a traffic stop in Indianapolis, a 23-year-old man admitted to smoking marijuana and surrendered a small amount that he had in his possession. As a result, the man was charged with operating a vehicle while intoxicated (OVWI) and possession of marijuana, which are both misdemeanor offenses. The man’s license was immediately taken and he was now faced with the stark reality that each charge was punishable with up to a year in jail, hefty fines, and a yearlong license suspension. The prosecutor agreed to dismiss the marijuana possession case completely and attorney Hessler was able to arrange for a reduction to the OWVI charge to a lesser misdemeanor. While this agreement included one year of probation, there would be no jail time and the man’s license was reinstated right away. The man was very pleased with the conclusion of his case, which allowed him to avoid a marijuana possession conviction and continue driving.
